SC notice to Centre on IAF Pilot's petition
New Delhi, Apr 23: The Supreme Court has issued notice to the Centre on a petition filed by a pilot seeking release from Indian Air Force (IAF) service after reimbursing IAF for the training cost.
A bench comprising Mr Justice B N Srikrishna and Mr. Justice Tarun Chatterjee issued notices last week on the petition of Squadron Leader Shakul Tyagi who has sought directions to the authorities to reconsider his application for premature release dated Aug 30, 2004.
The petitioner has come in appeal against Delhi high court judgment dismissing his writ petition on the grounds that lot of expenditure had been incurred on training by IAF ands hence he could not allowd to go out irrespective of the circumstances which he faces.
The petitioner is seeking premature release from service on grounds of conjugal disharmony as per the human resource policy on the subject made by IAF.The petitioner is prepared to reimburse IAF for expenditure incurred by it on his training. He is a helicopter pilot in the IAF. The petitioner who was awarded during Kargil operations has completed 13 years of srvice and training expenditure is recoverable only up to ten years of service.
