AG spells out laws on office of profit in state assembly

Kohima, Apr 4: Nagaland Advocate General K N Balgopal today stated various provisions of the Constitution on the office of profit in an emergent session of the state Legislative Assembly here.

Governor Shyamal Datta had summoned the eleventh session(emergent) of the Tenth Nagaland Legislative Assembly to discuss the office of profit issue in the floor of the house.

Speaker Kiyanilie Peseyie has asked leader of the house Neiphiu Rio to move a motion so that the Advocate General could speak about the interpretation of the entries in the schedule to the Nagaland Legislature members (Removal of Disqualification) Act, 1964, which was put for voting.

Accordingly the motion was admitted in the house by voice votes.

Mr Balgopal interpreted all the definitions and provisions of the Act in the house and also provisions of Article 191 of Indian Constitution, which defines the office of profit. He also urged the members of the house to wait till the Parliament enacted or amended the provisions of the Constitution. Later, Mr Rio moved a resolution, ''This house concurs in the interpretation of the entries in the schedule to the Nagaland State Legislature Members (Removal of Disqualification) Act 1964.

prepared by the Advocate General in the house on April 4, 2006 and resolved that the interpretation of the said entries in the said Act so concurred by this house shall be deemed as expression of the legislative intent behind the said entries.'' The Speaker had put the resolution for voting and passed by voice votes.

After the business of the house was over, Mr Kiyanilie adjourned the house sine die.
