Chennai, Mar 31 (UNI) Madras High Court today dismissed an anticipatory bail petition filed by a Congress party functionary who apprehended arrest in connection with violence near the TNCC office here during the protest against the suspension of former Congress MLA Dr Chella Kumar.

Mr Justice K N Basha dismissed the anticipatory bail petition by North Chennai District Congress Committee President Royapuram Mano, stating that this court did not want to observe anything on the merits or demerits of the case. In any case the court felt this was not a fit case for grant of anticipatory bail.

Mr Mano submitted that the case was registered on the basis of a complaint given by one Arul Pethiah, who belonged to the rival group of the Congress headed by Dr Chellakumar. Following the suspension of Dr Chellakumar for indulging in anti party activities, on March 25, his henchmen had forcibly entered Congress headquarters, Sathyamurthy Bhavan and indulged in violence, he said. The mob tried to enter the building using force and threats.

Congress partymen present then, including the petitioner, prevented them from entering the office and chased them away. At that time, the petitioner was pushed and attacked by the mob. Over this incident, two complaints were lodged - one by Arul Pethiah and another by V Balaraman against Arul Pethiah and others.

Mr Mano accused the present ruling party of trying to curtail and prevent his political activities by foisting the case on him.

''The action initiated against me was the outcome of vindictive attitude of the police, acting at the instance of the ruling party.

Police had not initiated any action in respect of the complaint given by Mr V Balaraman,'' he added.
