SC upholds right of government to abolish post
New Delhi, Mar 28 (UNI) Dealing a stunning blow to the champions of the rights of the working class, the Supreme Court today upheld the right of the central and state government to abolish posts as well as to increase or decrease the strength of its staff as per requirement.
The ruling was handed down by a bench comprising Mr Justice H K Sema and Mr Justice Dr A R Lakshmanan on the petition of the Avas Bikas Sansthan (AVS). They also held that the terminated employees do not have any right of re-employment unless their termination is malafide.
The ruling came on petition filed by the employees of AVS which was closed down by the order of Rajasthan government as they were running in huge financial losses and were not in a position to pay the salaries to its staff.
