Private lawyer cannot hold brief for govt counsel: HC

Allahabad, Mar 20 (UNI) Allahabad High Court today observed that where state government/power corporation/any instrumentality of the state appoints a counsel, only he could hold the brief and not any private lawyer.

The court said a counsel so appointed could not even hand over the government file/briefs to a private lawyer.

Giving this observation, Justice Rakesh Tiwari rejected a recall application moved on behalf of Uttar Pradesh Power Corporation (UPPC) on the ground that the counsel, who was present to argue, was neither on the UPPC panel nor had authority to hold the brief of Corporation's counsel or argue the application in his absence.
