HC disposes petition against Nayak

Mumbai, Mar 20 (UNI) The Bombay High Court today disposed of a petition filed against suspended encounter specialist Daya Nayak after it was told that anti-corruption Bureau (ACB) had registered an offence against the police officer and others for allegedly possessing properties disproportionate to their known sources of income.

A division bench comprising Justice D G Deshpande and Justice V K Tahilramani disposed the petition filed by former journalist Ketan Tirodkar, seeking court's nod to direct ACB to conduct an inquiry against Nayak.

Mr Tirodkar had earlier alleged that Daya had properties and cash running into crores of rupees and had nexus with the underworld.

He also claimed that Daya had links with politicians Ajit Pawar, among others, and as such the police was not taking any action against him.

In reponse to the petition, Chief Public Prosecutor contended that ACB had already registered an offence against Nayak, his wife Komal and his associate. ''All are in judicial custody except his wife who has been granted anticipatory bail by the Bombay High Cour,'' the Prosecutor added.

After perusing the report submitted by ACB and statement made by prosecution, the court held that the investigation was going on in the matter and as the petitioners' prayers regarding Daya were met, the case can be disposed.

The court also held it would not intervene in the investigation process and thus the petitioner's prayer to probe the involvement of former 'Loksatta' journalist Dhananjay Karnik and Cabinet minister Ajit Pawar who, he alleged, were involved with fraudulent money transactions with Komal Nayak, would not be granted.
