Court rejects Nayak's bail

Mumbai, Mar 16 (UNI) A special ACB Court today rejected the bail application of suspended encounter specialist Daya Nayak and his associate Rajendra Padte, arrested in connection with a case of disproportionate assets against the police officer by anti-corruption bureau (ACB) on January 20.

Rejecting the bail plea, Additional Sessions Suman Mahajan said the investigations in the case were yet to be completed and if the accused were released on bail, they could tamper with the evidence The Judge also directed the prosecution to keep Nayak in the Bhoiwada police lock-up as there is threat to his life, while Padte be shifted to Aurthur Road jail.

Earlier, opposing the plea, Additional Public Prosecutor R V Kini had argued that statement of some of the witnesess were yet to be recorded and at this juncture, if witnesses were released on bail, they may temper with the evidence.

Mr Kini had also said that a detailed investigations into the two missing vehicles and verification of names and address of donors to his school project in his home town in Karnataka, besides some other financial transaction with a new company--Raj Darshan Property private ltd- required his custody.

Defence counsel Shirish Gupte had argued that both Nayak and Padte have been in their custody for the past 24 days, but since March 6, there has been no interrogation. Hence, they should be granted bail, argued UNI ST KD VD RN1908
