HC stays Minister's arrest

Nagpur, Mar 15 (UNI) The Nagpur bench of the Bombay High Court has stayed the arrest of Maharashtra Dairy Development Minister Anees Ahmed in a criminal case filed against him for allegedly making derogatory remarks against the aide of Congress MLA Nitin Raut from Nagpur.

Justice B R Gavai, in his interim order yesterday, restrained Nagpur police from arresting Ahmed for offences registered against him under section 3(I)(10) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989, till March 27.

The court also issued notices to the police to file a reply on the next date of hearing.

Senior advocate V R Manohar, appearing on behalf of Ahmed, challenged the registration of FIR against the Minister by the Sadar Police of Nagpur. He contended that since the complainant Ulhas Meshram did not disclose the caste to which he belonged, the case was untenable and needs to be quashed. Under the Act, it is mandatory upon the complainant to make such a disclosure, he contended.

He told the court that the complaint against the Minister had been made with malafide intentions and to tarnish his image in the eyes of the public.

''The complaint had been made at the behest of MLA Nitin Raut to gain political mileage,'' contended, adding that when Ahmed was sworn in as Minister, Raut too had been in the race for ministership but his name was dropped at the last moment.
