CAT quashes appointment of Rly Goods Guards

Chennai, Mar 14 (UNI) The Chennai Bench of the Central Administrative Tribunal (CAT) today quashed an order of the Financial Controller of Railways, Ministry appointing 69 applicants to the post of goods guards.

The CAT bench comprising Vice-Chairman Mr Justice P Shanmugham and Administrative Member V LakshmiRatan directed the authorities concerned to reappoint in accordance with the law, on a petition filed by K Munusamy and six other unsuccessful candidates.

According to the petitioners the notifications for selection were issued on different dates and the written examination and viva voice test were held on different dates and there was no uniform selection process. The rule of reservation was also not followed.

''As per the provisions contained in Indian Railways Establishment Manual, we find that none of the requirements were met with in the selection. There was no basis for the department to go for two notifications for the appointment of goods guards. We are of the view that the three selections to the post of goods guards are vitiated for the reasons of absence of common selection, want of uniform evaluation, award of grace marks and quota for one category and contrary to the laid down procedures, rules and norms. We are of the clear view that the selections are arbitrary, contrary to the rules and guidelines and therefore we have no other alternative but to quash the three selections made,'' the bench said.
