Delhi Police appeals against acquittals in Jessica case

New Delhi, Mar 13 (UNI) Squarely blaming the trial court for acquittal of nine accused in the Jessica Lall murder case, Delhi Police today filed a revision petition in the Delhi High Court saying ''the impugned judgement of February 21 is manifestly wrong, bad in law and contrary to the facts and evidence on record.'' The petition filed by Delhi Police Counsel Mukta Gupta said, ''The trial court fell into grave error in rejecting highly relevant material evidence in the instant case'' and acquitted the accused.

Refuting the two bullets theory of the Central Forensic Science Laboratory (CFSL) report, the petition said, ''The trial court grossly erred in holding the prosecution version that one accused had fired two shots from one pistol.'' The medical evidence shows that one gun shot injury i.e. entry wound, which is corroborated by the forensic expert, has not been challenged even in the cross examination by the accused, Ms Gupta said in the petition.

The prosecution case is that two shots were fired, one at the roof and other at Jessica, is duly supported by the medical evidence.

Sessions Judge S L Bhayana, who has been elevated as Delhi High Court Jugde, failed to appreciate that Jessica died of gunshot injury and a mutilated bullet was extracted from her body, the petition said.
