Daya Nayak's bail plea to be heard on Tuesday

Mumbai, Mar 12 (UNI) The bail application of suspended police sub inspector and encounter specialist Daya Nayak will come up for hearing before special ACB judge S P Mahajan on Tuesday.

The same day, the court will also decide on where to lodge Nayak during his judicial custody since the defence counsel has apprehended threat to his life in the Arthur Road jail. The Defence had urged that Nayak be lodged in the Bhoiwada police lock up where he has been kept since his arrest on February 20.

The court on Friday, however, directed that Nayak be lodged in the Bhoiwada police lock-up till March 14 and a decision on his future custody would be taken on that date.

Earlier, while rejecting the anticipatory bail plea of Nayak, the Bombay High Court had directed that Nayak be kept in a seperate cell and provided adequate security.

Nayak, arrested in a disproportionate assets case, had also been interrogated by the state CID before his suspension in connection with the disappearance of Mumbai blast accused Khwaja Yunus from police custody before. The local arms unit of the Mumbai Police had also quizzed him regarding the discrepancies in ammunition given to him.

Anti corruption bureau sleuths had registered a case on January 20 against Nayak, his wife Komal, and associates P Manivelan and Rajendra Phadte under the Prevention of Corruption Act for acquiring assets worth over Rs 41 lakh ''through corrupt means''.

The High Court had granted anticipatory bail to Komal but rejected the anticipatory bail applications of Nayak and Phadte.

Manivelan was the first to be arrested in this case and continues to be in judicial custody. He had also filed a bail application before the Bombay High Court two days also.
