Hearing on Daya's bail plea adjourned till March 14

Mumbai, Mar 10 (UNI) Special ACB Judge S P Mahajan today adjourned till March 14, the hearing on the bail application of suspended police sub inspector Daya Nayak and his associate Rajendra Padte as the prosecution sought more time.

The court, however, heard both sides on where to keep Nayak under judicial custody in view of threat to his life in Arthur Road Jail, as raised by the defence counsel.

Defence Counsel Shirish Gupte argued that Daya should be kept in the Boiwada police lock-up as there was threat from the criminal gangs, if he was kept at the Arthur Road jail.

He even cited the High Court order which, while dismissing Nayak's anticipatory bail plea, had directed that he be kept in a seperate cell and provided adequate security.

Public Prosecutor R V Kini told the court that Bhoiwada station incharge had also said his difficulty in keeping Nayak there as it is the only lock-up for nearby four police stations.

He said that Arthur Road Jail Superintendent in his report has said that though there are gangsters from different criminal gangs there,he could provide a seperate cell.

Mr Kini suggested to the court that Nayak could be kept eigther in Pune or Thane jail.

The court, however, ordered that Nayak be kept in the Bhoiwada police lock-up under judicial custody till March 14 when it decides the matter.
