CID directed to give 72 hrs notice to Sharma; plea disposed of

Mumbai, Mar 6 (UNI) Disposing off Police Inspector Pradeep Sharma's anticipatory bail application, Additional Sessions Judge S P Daware, directed the State CID to give a 72-hour notice to the police officer in case it (CID) needed his custody (in the sensational Khwaja Yunus case).

Fearing arrests following utterances of suspended encounter specialist Daya Nayak, prior to surrendering before the ACB court in a disproportionate assets case, that he was privy to certain information on the disappearance of Yunus from police custody, Sharma had filed an application for anticipatory bail last month.

The State CID, which is investigating into the Khawja Yunus case, today told the court that, ''as of now we do not have any intention to arrest Mr Sharma in this case. We have already recorded his statement.'' It was then the court directed the CID to give prior notice to Sharma in case it wanted his custody and disposed off the police officer's plea.

Mumbai police had claimed that Yunus, arrested for his alleged involvment in the Ghatkopar bomb blast case, had escaped from its custody while being taken to Ahmednagar for investigation.

However, a co-accused in the blasts case, had alleged that Yunus had died of torture in police custody during interrogation.

The State CID has already moved an application seeking court's permission to interrogate Daya Nayak with regards to his disclosure before the media about Yunus. It would file a supplementary report after interrogation of Nayak.
