HC to hear State plea in South African model rape case

Mumbai, Feb 26 (UNI) The Bombay High Court will hear on February 28 the State Government plea of the cancellation of the bail granted to Suresh Kishnani, an accused in the South African model rape case.

The State plea had on February 24 come up for hearing before Justice V M Kanade, who had partly heard it and adjourned the matter to February 28.

The State had challenged the order of Sessions Judge M D Jethani who had released the accused on bail after furnishing a surety of Rs 25000 in the last week of January.

In its plea, the State had prayed to the court to quash the Session Court order as the police were unable to thoroughly investigate the case relating to alleged rape of the model by two persons in the last week of December in the city.

The court was told that while granting bail to the accused, the Sessions Court had not patiently heard the prosecution and also did not take cognisance of the material produced before it.

On the other hand, the accused had opposed the State plea and submitted that the Sessions Court had not found any serious material against him.

The accused had also claimed that he had been thoroughly interrogated by the police. Sufficient time was granted to the police to complete the investigation hence the bail granted to him should not be cancelled and court should dismiss the State plea, the defence counsel had argued.
