With only a bunch of audio recordings and lack of material witness, the trial against Lt Col Srikant Purohit is expected to start on a weak footing. It was in fact these factors which were also taken into consideration by the Supreme Court of India which granted him bail earlier this week.

The recordings have conversations of Purohit. In one of the conversations he is heard saying, " the cat is out of the bag." Purohit has always maintained that he was undercover trying to penetrate into a terror cell and he had kept his superiors in the loop about the same.

Now coming to the point of the material witnesses, there are none. Three witnesses who had said before the Maharashtra ATS that he was an intergral part of the probe went back on their statements. They retracted before the NIA which took over the probe from the ATS.

The other charge that Purohit supplied the RDX has fallen flat. The NIA in its report clearly states that an ATS officer had planted the RDX in the house of one of the accused. This was centric to the case against Purohit and the ATS repeatedly claimed that it was he who supplied the RDX. However the NIA negated this theory completely.

This would mean that the prosecution would cling on to the audio clippings. While the investigators say that these are good evidence, it would be extremely difficult to prove that Purohit is the mastermind and the conspirator based on these clips.
