SC to hear CBI’s appeal against acquittal of Talwars in Aarushi murder case

New Delhi, Aug 10: The Supreme Court on Friday admitted the CBI's appeal against the aquittal of Rajesh and Nupur Talwar in the Aarushi murder case.

The Central Bureau of Investigation (CBI) had in March appealed before the apex court against the acquittal of Rajesh Talwar and Nupur Talwar in connection with the murder of their daughter Aarushi Talwar and their domestic help Hemraj in 2008.

The Talwar couple had walked out of Ghaziabad's Dasna jail last October after they were acquitted by the Allahabad high court. A bench of Justice BK Narayana and Justice AK Mishra of the Allahabad High Court had acquitted the Talwars by giving them the benefit of doubt.

A Ghaziabad CBI court had in 2013 sentenced Talwars to life imprisonment.

Prior to that, the CBI had filed a closure report in the CBI court saying it was not able to bring murder charges against anyone because of insufficient evidence. The CBI court rejected the closure report and proceeded with the trial against the Talwars saying there was enough circumstantial evidence despite the agency's closure report.

Aarushi was found dead in her bedroom days before her 14th birthday in May 2008. Live-in help Hemraj was the main suspect till his body was found a day later on the roof of the Talwar's apartment in Noida.

The CBI, had in it appeal against the Allahabad HC verdict, said the HC had erred by not taking into account important circumstantial evidence, which assumed significance in a case of this nature where there were no eyewitnesses.
