Sources say that in the first letter dated May 15th states that the BJP with 104 MLAs should be invited to form the government as it is the single largest party. The second letter dates May 16th has similar contents. It says that the BJP is the single largest party and hence should be invited to form the government.

The Governor took note of the letters and while applying the precedent set by the S R Bommai verdict invited the BJP to form the government on the ground that it is the single largest party.

The Supreme Court during the dramatic mid-night hearing had directed the Attorney General to produce the two letters. Also under consideration would be the time given by the Governor to Yeddyurappa to prove his majority on the floor of the House. It was argued that Yeddyurappa had sought 7 days but the Governor granted 15.
