Mahadayi: Centre obligated to mediate, states must cooperate

Amidst the huge political row, the final hearing in the Mahadayi waters issue will commence tomorrow. Karnataka is set to advance its final arguments before the tribunal starting Tuesday.

Mohan Katarki, advocate for Karnataka says that they would be replying to a contempt petition that has been filed by Goa.

On the current status of the issue, Katarki tells OneIndia that the tribunal had asked the states to explore and see if there could be an out of court solution.

On why no negotiations have taken place, Katarki said that usually no such deliberations are held when the matter is in court. It is considered to be sub-judice, he also said. He said that in such matters, the judicial power is with the tribunal.

The Centre can only act as a mediator in such cases. It owes an obligation to mediate and all states owe an obligation to cooperate, he also said. Such cases are not like those concerning individuals. None are constitutionally bound. It is all about the upkeep of the Constitution, he also said.

On the Cauvery waters verdict, Katarki said that they are expecting the judgment this month. It would be out on or before February 23, he said.
