Love Jihad: NIA can probe Shafin, but marriage issue different says SC

The Supreme Court has said that the National Investigation Agency is free to investigate Hadiya's former husband Shafin Jahan. The court however made it clear that it would allow the probe under the pending habeas corpus petition.

The court said that it cannot go into the marital status if the girl says she married her choice. The hearing into the marriage and the probe against Shafin have to be different the court observed while making Hadiya a party to the proceedings.

Jahan had challenged the annulment of his marriage with Hadiya by the Kerala High Court.

Kapil Sibal appearing for Shafin, however, sought for a probe under a retired judge.

However, Hadiya's father alleged that she was forcibly converted. He also alleged that Shafin had terror links.

The NIA which took over the probe has been probing an alleged case of Love Jihad. The NIA had found that Shafin was in the chat and social media groups being run by two operatives arrested in an Islamic State case. It wanted to probe Shafin's links with the two. The NIA had also questioned the two operatives in a Kerala jail recently and they confirmed that they knew Shafin.
