Kerala High Court allows couple to live together, says live-in relationship has become rampant

In a historic order, the Kerala high court on Friday allowed a 19-year old girl and an 18-year-old boy to live together. The high court also said that it can't close its eyes to the fact that live-in relationship has become rampant in our society & such living partners can't be separated.

The Supreme Court had recently held that adults have the right to be in a live-in relationship, even if they have not attained the legal age for marriage.

The Supreme court held that live-in relationships were now even recognized by the Legislature and they had found a place under the provisions of the Protection of Women from Domestic Violence Act, 2005.

A bench, comprising Justice V Chitambaresh and Justice K P Jyothindranath, dismissed a petition filed by the girl's father and said that such partners cannot be separated by the issue of a writ of a habeas corpus provided they are major.

"The constitutional court is bound to respect the unfettered right of a major to have a live-in relationship even though the same may not be palatable to the orthodox section of the society. The court held that the girl is free to live with the boy or marry him later when he attains the marriageable age," the high court said in its judgment.
