Jaya appeal- Will prove Karnataka was thrown out of first appeal says Dave
New Delhi, Nov 23: The hearing of the appeals in the disproportionate assets case against Tamil Nadu chief minister, J Jayalalithaa will be taken up on a day to day basis by the Supreme Court of India from February 2.
The Supreme Court which fixed the date today said that it would ensure that all parties would get a chance to be heard and the proceedings would be conducted on a day to day basis.
On the last date of hearing, Jayalalithaa's counsel Nageshwar Rao told a bench comprising Justices P C Ghose and R K Aggarwal that the appeals must be heard early. The Bench stated that there were some incomplete pleadings and hence they would take up the matter on November 23 for fixing a date.
Appeal proceedings could take three months:
Since the case is a voluminous one, the case mandated a day to day hearing. There would be arguments advanced by Karnataka which is the prosecuting state. In addition to this the DMK's Anbazhagan who has also filed an appeal against the acquittal of Jayalalithaa will submit arguments as well. The Supreme Court would then hear the reply by Jayalalithaa's counsel which would be followed by the Karnataka government filing its counter.
All these legalities and proceedings could take at least three more months, legal experts feel. Karnataka will be represented by senior advocate Dushyanth Dave and special prosecutor B V Acharya. During the last date of hearing, Dave said that he will prove to the Supreme Court how Karnataka had been thrown out of the first appeal before the Karnataka high court. This led to the order of acquittal, Dave had pointed out.
Confiscation of property case:
The Supreme Court also hear a separate petition filed by Anbazhagan challenging the Karnataka High Court order setting aside the confiscation of properties held by Indo-Doha Chemicals and Pharmaceuticals Pvt Ltd., Signora Enterprises Pvt. Ltd., Ramraj Agro Mills Ltd., Meadow Agro Farms, Riverway Agro Products "for and on behalf of Ms. Jayalalithaa".
Karantaka had moved the Supreme Court challenging the acquittal of Jayalalithaa and three others in the disproportionate assets case. After the trial court had convicted all four, the High Court reversed the order and ordered the acquittal.
