As Yeddyurappa faces floor test, here is what Rules 340, 346 say

All eyes would be on Karnataka as the crucial trust vote would be held today. Rule 340 of the Karnataka Assembly Rules would be in focus as the decision of the House would be decided by means of a question put by the Speaker on the motion made by a member.

As Yeddyurappa faces floor test, here is what Rules 340, 346 say

In all likelihood the Speaker, would apply Rule 346 by which voting would be done through a voice vote with the members says either 'ayes' or 'nay.' The Speaker would then determine the outcome on the voice vote. In case his decision is challenged then he would clear the lobbies, close the doors and then put the motion to a voice vote again.

In case the decision is challenged again, then the Speaker will ask the MLAs to rise in their respective seats in support or against the motion. This time the number of MLAs standing will be counted and the decision taken. While the names of the legislators will not be recorded, the rules state that the seating of the members would be decided by the Speaker.

The current strength of the House is 222 as elections to the Jayanagar and Rajarajeshwari constituencies have been postponed. H D Kumaraswamy of the JD(S) has won from two constituencies as a result of which his vote would be counted only as one. This means the magic number would be 111.

The Speaker would not cast his vote unless it ends up in a tie as per Article 189(1) of the Constitution. The trust vote in Karnataka would be a simple one where the MLAs would vote either in favour of against Yeddyurappa. In case he fails the floor test then the next MLA claiming majority would face the floor test.
