Aarushi murder: The outsider theory has returned

The court stressed on the basic legal tenet that it is for the prosecution to prove beyond reasonable doubt and give conclusive proof.

A bare understanding of the verdict in the Aarushi Talwar murder case suggests that the outside theory has come back to life. With the court acquitting Dr Rajesh and Nupur Talwar while giving them the benefit of doubt, the Allahabad High Court discredited the theory that an outsider was not involved.

The court stressed on the basic legal tenet that it is for the prosecution to prove beyond reasonable doubt and give conclusive proof. The court also noted that the parents cannot be held guilty just because they were in the house at the time of the crime.

This once again brings up the question-" who killed Aarushi and Hemraj, the domestic help?" When the CBI began the probe there were three suspects in the case. The first probe by the CBI had identified Krishna, a help at Dr Rajesh's clinic, his friend Rajkumar and Vijay a driver as the suspect. They were arrested on the basis of circumstantial evidence.

In the narco analysis test it was concluded that the above mentioned persons had a role to play. However a narco analysis test is never accurate and hence is not admissible as evidence. All three were discharged from the case as the CBI was unable to prove their involvement. The missing murder weapons was another reason for the CBI's theory to fall flat.

During the trial the counsel for the Talwars had quoted an alleged confessional statement given by Krishna in which it was stated that the khukri was the murder weapon. However the court trashed argument. The court said that it was not possible that at midnight Krishna, Rajkumar and Vijay Mandal would come to the room of Hemraj and have liquor, as alleged. In absence of any possibility of an outsider entering the house, the servants could not be linked to the murder, the court also held.
