"Gaddafi has been physically attacked," he said adding that Libya was depriving him of his fundamental rights.
"He also suffers pain due to the absence of dental treatment," said the lawyer. He, however, did not divulge into the details of where the attack took place.
Saif-al-Islam was arrested on the grounds of crimes against humanity for his alleged role in the Libyan uprising against his father Gaddafi.
Keita said Saif's "effective representation cannot be secured in a setting in which the OPCD has no ability to conduct privileged communications with Gaddafi on an ongoing basis, or to transmit privileged documents to him," read the statement.
"Gaddafi has been interviewed by domestic authorities without the benefit of legal representation, and has been provided misleading information concerning the status of domestic investigations against him," it said.
Muammar Gaddafi, the long time ruling dictator of Libya was shot dead outside his hometown of Sirte on Oct 2011.
