Apple wins; German court bans Samsung Galaxy sale in EU

San Francisco, Aug 10: A German court asked the Seoul-based consumer products manufacturer Samsung not to sell its flagship Galaxy tablet in the European Union except the Netherlands.

The court order came after its rival Apple moved to court demanding that the Samsung Galaxy line of mobile phones and tablets "slavishly" copied the iPhone and iPad.

After the court ordered on Tuesday, Aug 9 sources said that Apple will apply to have the injunction extended to the Netherlands before the patents court. Meanwhile, Samsung officials said that they were disappointed with order and will act immediately to withdraw the ban.

"Samsung is disappointed with the court's decision and we intend to act immediately to defend our intellectual property rights through the ongoing legal proceedings in Germany and will continue to actively defend these rights throughout the world," a Samsung spokesman said.

The latest fight between these market leaders started on Apr 15 after Apple's petition in California federal court saying that Samsung's Galaxy smartphones and tablets violated patents laws by copying its iPads and iPhones.

Later, Samsung urged the court to ask Apple to show their upcoming iPad 3 and iPhone 5. But Apple retorted saying that Samsung's demand to see the next versions of iPad and iPhone was an "attempt to harass."
