Supreme Court quashes summoning of Mittal and Ruia in 2G case
New Delhi, Jan 9: In a relief to Sunil Bharti Mittal of the Airtel and Ravikant Ruia of the Essar Group, the Supreme Court on Friday quashed the order by the 2G special court summoning them to appear before it to face trial in an alleged conspiracy in the allocation of excess spectrum in 2002.
An apex court bench of Chief Justice H.L. Dattu and Justice Justice A.K. Sikri said the legal principles have been wrongly applied by the trial court.
Mittal and Ruia, whose names were not mentioned in CBI's chargesheet as accused, were summoned in 2013 by the special CBI court saying there was "enough material" to proceed against them in the case.
Following this, both Mittal and Ruia had approached the Supreme Court, challenging the order.
The case relates to alleged irregularities in allocation of additional spectrum - 10 Mhz instead of 6.2 Mhz.
