Mechanism needed to settle matrimony disputes at earliest: HC

Mumbai, Oct 23: The Bombay High Court has suggested that a mechanism be evolved to ensure matrimonial disputes are heard and decided or resolved within a fixed time frame so that the parties involved can move on with their lives.

A division bench headed by Justice V M Kanade was recently hearing an appeal filed by a 42-year-old man challenging a family court order passed against him on an application filed by his 36-year-old estranged wife.

When the court was informed that their dispute has been going on since nine years and they have a 10-year-old child, Justice Kanade said, "They are separated since nine years and are still stuck in a logjam. There is a minor child involved in all this."

The court noted that parties involved in such disputes lose the prime of their lives fighting with each other.

"The agony the litigants face each and every day is unnerving," the court said. "Some mechanism needs to be formulated to ensure that matrimonial disputes are resolved or decided within a fixed time schedule. This will at least help the parties move on with their lives," Justice Kanade said.

The court suggested the parties involved need to be practical and try arriving at an amicable solution to their issues.
