It appears that Kumar Vishwas is in for a lot of trouble and a lot would depend on how the police handle the complaint filed against him by the BJP. With Kiran Bedi charging that his comments are sexist in nature, the charges would range from defamation to making sexist comments against a woman.
What irritated the BJP?
The BJP is miffed with Kumar Vishwas for two statements that he made.
In the first comment he asks the BJP whether the muffler that they keep referring to was stolen.
His exact words were the BJP has two problems with Arvind Kejriwal.
One. he wears a muffler. Has he stolen it from you, he asks the BJP.
The second comment the BJP says was below the belt and sexist in nature. The BJP says Kejriwal coughs a lot. What is your problem, do you have to sleep with him in the bedroom, Vishwas asks.
The charges against Vishwas:
The BJP has put in a strongly worded complaint against Vishwas. It is now up to the police to probe into the incident and then file appropriate charges.
The strongest case against him would be that of defamation under Section 499 and Section 500 of the Indian Penal code.
While Section 499 deals with the definition, Section 500 prescribes the punishment. As per Section 500 of the IPC, if a person is held guilty of making defamatory remarks he could face a jail term of up to 2 years or fine or both.
