How Sasikala can pay the Rs 10 crore fine imposed by Supreme Court

The first choice before Sasikala is to pay up the amount as per the order of the court. However when the money is paid she will have to explain the source of the same.

Sasikala Natarajan will have to spent an additional 13 months in jail if she fails to pay the fine of Rs 10 crore imposed on her by the Supreme Court of India which convicted her in the disproportionate assets case. A circular was issued on Tuesday which directed her to pay the fine failing which she would have to spend 13 months in jail apart from the 3.6 year sentence she is serving since the past week.

The first choice before Sasikala is to pay up the amount as per the order of the court. However when the money is paid she will have to explain the source of the same. The money cannot be paid out of ill-gotten wealth. The authorities will demand for the exact source of the money before even collecting it.

How Sasikala can pay the Rs 10 crore fine imposed by Supreme Court

In case she is unable to pay the money, then the Karnataka government will have to go back to the court seeking to attach her properties in a bid to recover the money.

Once the court allows this application, then properties in her name would be identified. The properties would then be evaluated and then auctioned off. The proceeds from the same will be collected by the government. However the fine amount collected would not remain with the government of Karnataka. Since the original case was filed in Tamil Nadu, the money would go to the treasury of that state.

If Sasikala fails to pay the money and the authorities are unable to identify any property to auction, then she would have no option but to spend extra time in jail. The other question is if someone can pay it on her behalf. Legal experts say that the same could be considered provided that person explains the relation and also provides ample proof that the money is not part of any ill-gotten wealth, but rightfully earned. However the state of Tamil Nadu cannot pay this amount on her behalf, experts say on a lighter note.
