The Election Commission is likely to revoke the interim general secretary post held by Sasikala. as there is no such provision in the party's constitution. The EC had been petitioned about the same and is likely to pass an order to this effect soon. However if the EC revokes her position, it would not stand in the way of her becoming CM as she has been elected as the leader of the AIADMK legislature party.
The contention raised was that only a member who has spent five years in a row can be general secretary. Sasikala was however expelled from the party in 2011. While she returned to Poes Garden she was not given the party's primary membership.
The petition states that there is no continuous tenure of five years and hence she cannot hold the post of general secretary. The petition also says that a post of interim general secretary cannot be created as it does not exist in the party's constitution. Although the party had claimed that these hurdles would be removed, the same had not been done and the constitution not amended as yet.
It may be recalled that several conventions were broken to bring Sasikala into the party's top post. She was made interim general secretary despite not being a member of the party. A post of interim general secretary was created for her. Lastly, the electoral convention too was broken. Leave alone winning an election, she has not contested one too.
