Sources at Juhu police station said 22-year-old Suraj was taken for questioning around 6.30 pm on Monday and was arrested soon after. He was charged under Section 306 (abetment to commit suicide) of the Indian Penal Code, the police said, adding that he will be produced before the Andheri court on Tuesday.
Suraj was arrested on the basis of Jiah's suicide note where the latter said that she was left in pain to see her boyfriend's "womanising". She also wrote that she was cheated by the person she loved and had been forced to abort her unborn child.
The note said: "When I first met you (Suraj) I was driven, ambitious and disciplined. Then I fell for you, a love I thought would bring out the best in me. I don't know why destiny brought us together. After all the pain, the rape, the abuse, the torture I have seen previously I didn't deserve this."
"I've lost everything. If you're reading this I might have already left or about to leave. I am broken inside," it says. "It didn't matter how many gifts I gave you or how beautiful I looked for you. I was scared of getting pregnant but I gave myself completely (the) pain you have caused me everyday destroyed my soul."
The six-page note was found by the young actor's younger sister on June 7.
The deceased actor's mother, Rabiya Khan, alleged on Monday that Jiah was made to suffer by Suraj and his father. Jiah's family handed over the note to Juhu police on Saturday and her mother and sister's statements were recorded again in front of an independent witness.
