Hit & Run: Judge asks Salman to approach High Court

Mumbai, March 7: Will the Bombay High court take over the infamous 2002 hit-and-run-case, where actor Salman Khan's vehicle had run over people sleeping on the pavement? In the incident one person was killed and four others were injured.

The 47-year-old Bollywood superstar on Wednesday had approached a Mumbai Sessions court challenging an earlier order of a lower court.

"The matter is interlocutory in nature and therefore you should approach the Bombay High court as I don't have the jurisdiction to hear the same," the judge said before adjournment.

The matter will again come up in the court on Friday, March 8. In his petition at the Mumbai Sessions court, Salman said that the lower court's order was "bad in law" and "erroneous".

In January 2013, Additional Chief Metropolitan Magistrate V S Patil slapped the charge of ‘culpable homicide not amounting to murder' on the actor and referred the case to Sessions Court for trial. At present, Salman is being tried under section 304 (I), (rash and negligent driving) which attracts maximum punishment of two years. Section 304 (II) attracts the maximum sentence of ten years.

On the fateful night of September 28, 2002, the actor allegedly driving under the influence of alcohol had run over his Toyota Land Cruiser on homeless people who were sleeping on the pavement. In the accident one person was killed and four were injured.
