Delhi: Court says sixth accused a minor, not to face trial?

New Delhi, Jan 28: Juvenile Justice Board on Monday, Jan 28 declared that the sixth accused of infamous Delhi gang-rape is indeed a juvenile. Hence he will be tried in the case as a minor and may be spared from facing trials in fast-track court which is hearing the case of other five accused.

Citing the school certificates provided by the accused, the JJ Board claimed that the date of birth of the sixth accused is - 04.06.1995. The juvenile board overruled demand of Delhi police saying that the accused will not face a bone ossification test.

Expressing its confidence in the authenticity of the school certificate, the board said that bone test would have been allowed only if the board had raised doubt about the certificate.

However, Ishkaran Singh, lawyer against the accused, claimed that they will move the higher court. As a minor, the accused can only be tried under the Juvenile Justice Act for the crime and be given a maximum jail term of three years.
