The court freed the 51-year-old father, Kishore Chauhan and the 56-year-old astrologer, Hasmukh Rathod as police failed to accumulate enough evidences against the two accused. The mother of the two victims has also been let off by the court. The mother was accused of abetment.
The two sisters, who were 21 and 15 then, had filed the complaint against their biological parents and against the astrologer in 2009.
The elder sister reportedly was being raped for several years by her father and by the astrologer. Cahuhan and Rathod were also accused of having group sex.
However, Rathod's lawyer argued in the court by saying, "Rathod is highly diabetic and his private parts are non-functional. The medical reports have proved it."
Rathod's counsel also argued that considering his (Rathod's) "age, health condition and the size of the bed", it was impossible for Rathod to indulge in group sex.
The court also snubbed the black magic charge against Rathod. The two daughters had accused their parents and Rathod of playing black magic.
