Aarushi case: Talwars challenge CBI court order in Allahabad HC

Allahabad, Feb 21 (ANI): Aarushi Talwar's parents, Dr. Rajesh Talwar and Dr. Nupur Talwar, moved the Allahabad High Court on Monday challenging a order issued by the special Central Bureau of Investigation (CBI) court earlier this month, whereby they have been accused of killing their teenaged daughter.

In their petition, the Talwars' have challenged the order issued by the Ghaziabad special CBI court on February 9, whereby they have been accused of having murdered their daughter and the domestic help Hemraj besides engaging in criminal conspiracy and destruction of evidence.

Talwars' counsel Gopal Chaturvedi said the petitioners have submitted that the CBI court had passed its order 'without taking into consideration the objections submitted by us'.

The hearing in the case is likely to come up on Wednesday.

Earlier on February 9, the Aarushi Talwar murder case took a dramatic turnaround with the special Central Bureau of Investigation CBI court in Ghaziabad accusing the Talwars' of killing their daughter, and charging them under Sections 302, 201 and 34 of the Indian Penal Code (IPC).

Aarushi's parents, who face charges of murder and destruction of evidence, have been asked to appear before the court on February 28.

The CBI has been arguing in court that it should be allowed to close its investigation into the Aarushi case because it has not found enough evidence to charge anyone with her murder. However, the agency has listed her father Rajesh Talwar as its only suspect.

Aarushi, 14, was found murdered under mysterious circumstances in her parents' Jalvayu Vihar apartment in Noida, May 16, 2008. Their domestic help Hemraj's body was found on the flat's terrace a day later. (ANI)
