HC imposes Rs 1 lakh cost on Plaza owner in metro rail project
Bangalore, Feb 7 (PTI) Karnataka High Court today dismisseda writ petition challenging acquisition of Plaza theatre byBangalore Metro Rail Corporation Limited (BMRCL)for metro railproject and imposed a cost of Rs one lakh on them.
Justice B V Nagarathna dismissed the writ petition filed byShravani Properties Limited, owners of Plaza Theatre as "abuseof the process of court" since the same petition filed by thepetitioner had earlier been dismissed by the High Court andsubsequent Special Leave Petition filed in the Supreme Courthad also been dismissed.
The court also imposed a cost of Rs 1 lakh on ShravaniProperties.
As regards to the compensation offered by BMRCL (about Rs34.05 crore) which the petitioner had challenged, the courtstated that it was open to the firm to approach the SpecialLand Acquisition officer asking him to pass an award in thisregard.
