Ahmedabad, Feb 2 (PTI) Gujarat High Court today issued anotice to the state government while hearing a public interestlitigation (PIL), which sought inclusion of names of thosedisplaced by Ukai Dam Reservoir Project in the villagepanchayat voters list.
The notice was issued by the division bench of ChiefJustice S J Mukhopadhaya and Justice K M Thakar while hearinga PIL by Fulsinh Gamit, president, Adivasi Sarvangi VikasSangh in Uchhal taluka of Tapi district.
The court has asked the state government to file adetailed reply with regard to Gamit''s PIL in a month''s time.
According to the PIL, for the purpose of the constructionof the Ukai Dam and Reservoir, project affected people (PAP)from four villages in Uchhal taluka Mogalbara, Limbasiti,Pethapur and Nanchhal, were displaced and re-settled atanother place where the settlement was known as Chikhli.
Chikli has not been given the status of ''village'' ascontemplated by Article 243(g) of the Constitution of India.
Gamit has sought direction for the state government forconstitution of village Panchayat at Chikhli settlement andinclusion of the names of the project affected people in thevoters list of either the same village or nearby village.
He contended that since names of the project affected arenot included in any of the village panchayats list, they canneither prepare nor implement any plan for their economicdevelopment and thus, they are being deprived of the benefitsenvisaged from the Constitution. (More) PTI PB PD VKV
