New Delhi, Nov 21 (UNI) The Supreme Court has upheld the conviction and life sentence of appellants convicted for the murder of former Rajya Sabha member and Congress party general secretary Abdul Rauf Mohammed Bhai alias Rauf Valiullah, who was gunned down on October 9, 1992, in Ahmedabad.
Prosecution said that on August 3, 1992, one Hansraj Trivedi, an alleged supplier of illicit liquor and eight others were gunned down at Radhika Gymkhana club, Ahmedabad.
The prosecution said Abdul Latif and his gang members were the main suspects. Initially the local police did not act but under public pressure police swung into action.
Abdul Latif and members of his gang planned surreptitious surrender of some unimportant members of their gang to shield the real culprits, it was said.
Latif also sought the help of the local politicians Hassankhan Shamsherkhan Pathan alias Hassan Lala.
The plan was foiled due to the stiff resistance by the Congress leader who had to pay the price with his life for taking on the gangsters, the prosecution said.
The task of killing the ex-Rajya Sabha member was entrusted to one Rasoolkhan Yakubkhan Pathan alias Rassol Party and his gang.
They could not get Rauf Valliullah for three-days but got him on the fateful day when he was to board his car.
Eleven accused were charged for the offences of criminal conspiracy, murder and sections 3 and 5 of the Terrorist and Disruptive Activities (prevention) Act (TADA) and the investigation was handed over to CBI.
The TADA court sentenced Javed Khan, Mohammed Taslim Mohammed Umar Sheikh and four others to life imprisonment.
In all, seven were sentenced to life imprisonment along with a fine of Rs 5000 each. One was acquitted.
A bench comprising Justices B N Agrawal and G S Singhvi while dismissing the appeals of Mohammed Ameen alias Ameen Chotely Raheem Mia Sheikh and others noted ''In the result we hold that the trial court did not commit any error in recording a finding that charges of conspiracy and murder are proved against the appelllants.
Consequently the appeal failed and are dismissed.'' UNI SC SV RP GC1923
