Nashik, Nov 17 (UNI) A local court today approved the application of Swami Dayanand Pandey, accused in the September 29 Malegaon blast case, demanding presence of a lawyer or his relative during his custodial interrogation.
The application was produced before Justice H K Ganatra by Defence lawyer Kishor Vig after the Swami had alleged of physical torture by ATS and that his life was in danger in their custody.
The court approved the application but the lawyers here not throughout the interrogation. It permitted the presence of the lawyer only when asked by the accused or when required.
Another application moved by Sadhvi Pragya Singh Thakur's lawyers accusing the ATS of ill treatment, physical, mental abuse was pending before the court. Hearing on it would take place on November 29.
Pragya had also demanded scientific tests of the investigating officers in the affidavit.
The application by Gujarat police demanding custody of the Malegaon blast accused regarding the Modasa blast investigation, was filed by the court as there was no such provision, public prosecutor Ajay Misar said.
