Panaji, Oct 27 (UNI) The Bombay High Court's Goa bench directed state Advocate General Subodh Kantak to give copies of the investigation papers, regarding the sexual assault on a German minor girl, allegedly by the kin of two state ministers, in a sealed envelope by 1700 hrs today.
During the course of the hearing, Justice A P Lavande asked the Advocate General why no action was taken on a complaint filed by the girl's mother, Fadela Fuchs, from October 2 to October 10.
The court also directed Mr Kantak to file an affidavit about the further progress of the investigation by November four and adjourned the matter to November five.
Taking a suo moto notice, the Bombay High court had last Friday asked the Goa government to file its reply by October 27, as to why the investigation into the alleged rape of the German girl by two minister kin should not be handed over to a specialised Agency.
The mother of the 14-year-old victim has named Goa Education Minister Atanasio Monserrate's son, Rohit, as the suspect. The high court in the order asked the investigating officer to explain ''why none of the alleged accused has been apprehended'' yet.
This is not a question of suffering of an individual but has an effect on the society as a whole, a division bench of Chief Justice Swatanter Kumar and Justice S A Bobde had stated in the order on Friday. The court also asked the police to produce the record of investigation.
The German lady researcher also alleged that Warren Alemao, nephew of Goa PWD Minister Churchill Alemeao, too sexually abused her daughter. While Mr Warren has refuted the allegation, Rohit Monserrate is yet to be traced.
The allegation against Rohit was made on October two, but the FIR was lodged on October 14 against him by the minor girl's mother.
