HC summons deputy labour commissioner on Sep 17

Allahabad, Sep 9 (UNI) A division bench of the Allahabad High Court has directed the deputy labour Commissioner of Moradabad working under the Workmen's Compensation Act to be personally present in the Court on September 17.

A bench comprising justices Amitava Lala and A P Sahi gave the direction, on an application filed by an insurance company against an award given by labour Commissioner in favour of a claimant.

During the hearing the Counsel appearing for the insurance company stated that in spite of court's direction to hear the appeal and stay the application, the deputy labour commissioner had passed an order for release of the awarded amount in favour of the claimant.

The Court has summoned the labour Commissioner, as he had failed to maintain the judicial propriety.

The Court was of view that a person of legal fraternity should be appointed as a deputy labour commissioner under the Workman Compensation Act as any other person would be lacking judicial ethics.

Thus, on such posts, lawyers or retired judges should be appointed.

The Court has directed for intimating this order to the state government for consideration over the issue and its compliances.

The Court will hear this case on September 17.
