Patna, Sep 4 (UNI) The Patna High Court today directed the State Urban Development Minister Bhola Prasad Singh to file an affidavit within a week stating his position on the reported remark by him on 'functioning' of the High Court in the wake of its observation of hellish condition of Patna town due to piling of garbage in its various localities.
Justices Shiv Kirti Singh and S M Mehfooj Alam passed the directive on a petition filed by an advocate Khurshid Alam, who urged the court to initiate contempt proceeding against Mr Singh for his reported remark on functioning of the Patna High court regarding a huge number of pending cases there.
The bench observed that it would be proper to seek views of the Minister on his reported remarks against the court which appeared in a section of press.
In his petition, Mr Alam had stated that by making remark on the activities and jurisdiction of the High Court, Mr Singh made an offence tantamount to contempt of the court.
A few days back,hearing a petition of an NGO--peoples' watch on failure of the Patna Municipal Corporation in disposing off the solid wastes in its juridiction, Chief Justice of the Patna High Court R M Lodha had made the observation that Patna town had tunred hellish.
Following the court is observation of Mr Singh had advised it to work within its limits.
Mr Singh had further said the number of pending cases in High Court was an indication of its functioning. This remark had appeared in a section of the press.
