Patna, Aug 16 (UNI) Senior JD(U) leader and state Water Resources Minister Vijendra Yadav today took strong exception to the certain clause of Terms of Reference (TOR) of 13th Finance Commission saying it was against the federal spirit of the Constitution.
Mr Yadav told reporters here that according to TOR, for the first time, the Centre had asked the Finance Commission to consider the revenue worth of distribution between the Centre and the states, only after excluding what was being spent on defence and welfare scemes.
''The decision of the Centre would adversely affect the resources of the states as less revenue would be available for distribution between the Centre and the states, '' he said and added that Bihar would be among the worst sufferer states.
''The state government will urge the Finance Commission to recommend for financial state to Bihar as it had suffered most due to its bifurcation in 2000,'' Mr Yadav said adding Bihar had lost its vast mineral resources to Jharkhand after the bifurcation.
The TOR of 13th Finance Commission was in contravention of the TORs of the earlier Finance Commissions as it used to consider all the revenue collected by the Centre as various taxes, for distribution among the Centre and the states,ignoring what was being spent on defence and welfare scemes by the Union government.
''Such action on the part of the Centre was certainly against the spirit of the federal spirit of the Constitution,'' he added.
