New Delhi, May 15 (UNI) The Supreme Court today recorded the undertaking given by Kodanad estate in Ooty that it will allow the villagers to pass through the estate as was being done for the last several years.
Former Tamil Nadu Chief Minister and AIADMK supremo J Jayalalithaa is presently staying in a bungalow situated in the estate.
Tamil Nadu has come in appeal against the order of Madras High Court setting aside the order of the local magistrate to the estate owners to open the gates of the estate for the villagers so that they may pass through.
According to Tamil Nadu government, the estate owners have enclosed upon the public land and have closed the road in violation of the master plan converting the entire pathway into a private land.
The Magistrate had directed the estate to open the gates for the villagers.
This order was set aside by the High Court holding that estate cannot be forced to open the gates for the villagers on the grounds that they have been using the pathway for a long time.
Counsel for the state of Tamil Nadu pleaded for the stay of the High Court order but counsel for the estate gave an undertaking to the apex court that they would abide by the advice of the Supreme Court and allow the villagers to use the pathway through the estate.
The apex court recorded the undertaking and issued notices to the estate.
