Ambala, May 9 (UNI) The bail applications of kidney scam kingpin Dr Amit Kumar and his accomplice nurse Linda were dismissed by the special CBI Magistrate Dr Abdul Majid here today.
However, he granted bail to three other alleged accused Umesh, Ramesh and Suresh who had earlier applied for it.
The accused including the high-profile kidney scam kingpin Dr Amit, his brother Dr Jeevan, Dr K.K. Aggarwal, Dr Saraj and Dr Upender besides nurse Linda, Ramesh, Umesh, Suresh, Gyassudin, Harpal and Banarsi were present in the court.
Pooja, wife of Dr Jeevan had earlier been granted interim bail.
She had later applied for regular bail and exemption from personal appearance. The court has issued notice to the CBI in this regard.
The counsel of Dr Amit and Linda had argued that both should be granted bail since the CBI had not filed the chargesheet within the specific period of 90 days of their arrest.
However, the CBI counsel countered that the CBI had filed complaint in the beginning which was a charge sheet itself and contained all charges framed against the accused under the 1994 Rules pertaining to transplant of kidney.
The documents included the enquiry report of a team of doctors who had inspected and searched the premises of Dr Amit at Gurgaon and Faridabad, disclosure statements of Dr Saraj, Dr K.K. Aggarwal, Dr Jeevan and Dr Upender besides details of bank accounts of Amit.
It also stated that both Dr Amit and his brother were not qualified surgeon as required under TOHO Rules. They were accused of hatching a conspiracy with their accomplices to remove kidneys of innocent persons to transplant the same to wealthy people who paid them handsome amounts.
These beneficiaries included some foreigners also.
They were also guilty of running illegal and unauthorized laboratory, operating theatre and clinic where kidneys were removed in gross violation of rules and regulations.
