Supreme Court permits third floor only in residential localities
New Delhi, Apr 28 : The Supreme Court has permitted the construction of third floor in residential localities and not in commercial areas in the capital.
The Apex Court clarified the order after MCD counsel Sanjiv Sen moved an application before Bench of Justices Arijit Pasayat and Sathasivam seeking to know whether such constructions were permissible in commercial areas.
The counsel claimed that such a clarification was essential as the MCD officials were confused about the applicability of the Bench's earlier direction.
"There is no need for clarification. Your officials deal on case-to-case basis and suitcase-to-suitcase basis," the Bench remarked.
