Petition challenging Lalu's election dismissed by Supreme Court
New Delhi, Apr 4 : The Supreme Court on Friday dismissed a petition challenging Railway Minister Lalu Prasad Yadav's election from Bihar's Chapra Lok Sabha constituency.
A bench of Chief Justice headed by K.G. Balakrishnan dismissed the petition, which contended that Lalu could not have been elected from Chapra while already being a representative of Madhepura Lok Sabha constituency.
"We will not consider it. The petition is not maintainable," Balakrishnan said.
The petition, filed by advocate P C Sharma, sought stay on the appointment of Lalu Prasad Yadav as Minister, raising a constitutional question whether a member of Lok Sabha or Vidhan Sabha can contest the election for the same house, despite being its member from another seat.
