UP govt "unauthorised" to give reservation in judicial service: HC
Allahabad, Mar 10 (UNI) The Allahabad High Court has ruled that the Uttar Pradesh government was ''unauthorised'' to provide reservation in the recruitment of state judicial service and in the identification of its posts.
The HC bench comprising Justices Anjani Kumar and Sabhajeet Yadav said, ''In case a person is differentially abled, a notification of rules can be issued after the Governor's counselling into the matter.'' The government and legislature have no roles in the judicial service recruitment, the court maintained.
The HC dismissed the demand of reservation for physically handicapped in the recruitment of district judges and civil judges' junior category and appointed legal the Rule 4 of the UP judicial service rules, Rule 4, 5, 6 and 20 of the HC and the Right to Information Act, 2005.
The order was passed on a writ petition filed by one Devendra Nath Tiwari and others.
