Former DCP Pradeep Sawant victimised: HC

Mumbai, Mar 1 (UNI) ''There appears to be an ego clash between different investigating machineries..unfortunately former DCP Crime, Mumbai, Pradeep Sawant has been victimized in the exercise'', Justice S Radhakrishnan of the Bombay High Court has observed.

A division bench comprising Justice S Radhakrishnan and Justice Roshan Dalvi had given a split verdict recently over appeals filed by CBI, challenging Pune MCOCA court orders discharging Sawant and PI Vashishta Andhale.

Justice Dalvi has found prima facie case against both the officers and wanted them to face trial whereas Justice Radhakrishnan has dismissed the appeals and upheld the discharge orders.

Sawant and Andhale were discharged along with former Mumbai CP R S Sharma on June 26,2007.

In his version of the judgement, Justice Radhakrishnan has observed that Sawant had been victimised, saying that there was not even case of negligence or any dereliction of duty on his on any count and that it was unfortunate that he had to pay heavily at the cost of his integrity and career.

The judge sympethised with the former DCP Crime by recording that though damage caused to him and his career could not be undone completely, atleast some compensation could be bestowed on him by the Court, so that the lustre in his image could be restored and he could continue the rest of his tenure as a competent police officer.

The Judgment notes that the case against Sawant was based on wholly unsustainable evidence and therefore, he deserved discharge and no purpose would be served by allowing the trial againt him to continue. While giving a clear conclusion that no offence was committed by Sawant nor was he a party to any conspiratorial agreement or abetment to facilitate Organised Crime Syndicate, led by Abdul Karin Ladsab Telgi, kingpin of multicrore fake stamp scam.

Justice Radhakrishnan has also came down heavily on Subodh Jaiswal, who then headed Pune SIT investigating fake stamp related cases registered with Pune police. He has observed that it was only after the Crime Branch Unit-V Mumbai successfully raided a Bhiwandi Godown and seized huge stock of fake stamps along with 17 paper rolls, that the SIT, Pune was awakened as it would be detrimental to their image about the inaction and thus, it was claimed that the panchanama was fabricated.
