HC orders reconsideration of dismissed case
New Delhi, Feb 21 (UNI) The Delhi High Court has directed the Motor Accident Compensation Tribunal(MACT) to reconsider the case of a woman whose case was dismissed by MACT as two lawyers had contested her case separately.
Acting on a petition of one Kamlesh, whose husband was killed in July 1998 by a speeding truck, Justice Kailash Gambhir yesterday directed the Bar Council of Delhi to curb the menance of lawyers queuing up at the accidents victims house to get them a speedy compensation.
While one claim was filed by lawyer Yogesh Verma, another lawyer filed a separate petition on behalf of Kamlesh's minor daughter Rinki.
Unaware that two petitions had been filed in the court, Kamlesh watched helplessly as the MACT court viewed this as an attempt to mislead it and tossed both the claims out.
Kamlesh then moved the High Court and explained her predicament.
Justice Gambhir, keeping in view how the petitioner was taken for a ride by two unscruplous lawyers, ordered a fresh trial in the case.
